With election season underway and campaign signs appearing throughout the community, the City of Gibbon would like to provide a friendly reminder regarding proper sign placement.
Campaign signs may generally be placed on private property with the property owner's permission. Please make sure signs are located entirely on private property and do not interfere with traffic visibility, intersections, traffic signs, or signals.
Highway 30 / State Right-of-Way: Highway 30 is part of the State highway system. Nebraska Revised Statute §39-1359 reserves State highway right-of-way for highway and Nebraska Department of Transportation (NDOT) purposes. NDOT prohibits political campaign signs and other unauthorized signs within State highway right-of-way, including ditches, sidewalks, intersections, medians, and other areas within the State right-of-way.
City Streets, Right-of-Way & Public Property: Gibbon Municipal Code §94.03 provides for the City's maintenance and control of streets, alleys, public squares, and other public ways. Gibbon Municipal Code §130.05 further provides that City streets, sidewalks, and public grounds may not be used for signs, signposts, handbills, or advertisements without written permission of the City Council.
A good rule of thumb: Place campaign signs on the private-property side of the sidewalk, rather than between the sidewalk and street. Please remember that right-of-way boundaries can vary, particularly along Highway 30, so the sidewalk should not be considered the legal right-of-way boundary in every location.
Polling Places & Ballot Drop Boxes: Nebraska Revised Statute §32-1524 restricts electioneering within 200 feet of polling-place entrances and secure ballot drop boxes during applicable election periods. State law provides an exception for yard signs located on separately owned private property, subject to local ordinance.
These requirements apply equally to all candidates, campaigns, organizations, and individuals.
If you are unsure whether a location is on private property or within a public right-of-way, please contact the City Office before placing a sign.
Thank you for your cooperation and for helping keep Gibbon's streets and intersections safe.
